My 06 tranny has very rough shifting issues and they are replacing it. my question is do they replace it with a brand new one or a refurbished one?

The Dealer can answer that better than we...With an 06 I would specifiy a New Trans....you didn't buy a refurbished Car...

It seems usually these days all makers use remanufactured components.
Considering our engines are built in Germany and Australia along with the trannys in Japan it's unlikely they have them "laying around" or in-stock at a warehouse. I'm guessing you have an auto? Give us more info please
